This website is operated by Sur Books (ABN 56 118 878 009), a sole trader. Throughout the site, the terms “we”, “us” and “our” refer to Sur Books.

Sur Books operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify.

By accessing or using our Services, you agree to be bound by these Terms of Service and our related policies, including our Refund and Shipping Policies. If you do not agree, you must not use our Services.

1. ACCESS AND ACCOUNT

You must be at least 18 years old or have permission from a legal guardian to use our Services.

You agree to provide accurate, current and complete information when placing orders, including billing and shipping details. You are responsible for maintaining the confidentiality of your account and for all activity under it.

You may not transfer or assign your account to another person.

2. PRODUCTS AND AVAILABILITY

We specialise in curated books sourced both locally and internationally.

  • Some products are held in stock in Australia
  • Others are sourced from overseas suppliers (including Spain, Argentina and other countries)
  • Some items may be offered on a pre-order basis

We make every effort to accurately display our products. However:

  • colours and appearance may vary depending on your device
  • editions, covers or formats may differ between print runs or regions

All product descriptions are subject to change at any time without notice.

We reserve the right to:

  • limit quantities
  • discontinue products
  • restrict sales by region or customer

In rare cases, products may become unavailable after purchase. If this occurs, we will notify you and offer a refund or alternative.

3. ORDERS

When you place an order, you are making an offer to purchase.

Orders are not accepted until confirmed and payment has been processed.

We reserve the right to:

  • accept or decline any order
  • cancel or modify orders due to errors, stock issues, or suspected fraud

If an order is cancelled, a full refund will be issued.

Orders are for personal use only and not for resale or export.

4. PRICING AND BILLING

All prices are listed in Australian Dollars (AUD).

Sur Books is currently not registered for GST. Prices do not include GST. If our GST status changes, pricing will be updated accordingly.

Prices, discounts and promotions may change at any time without notice.

You agree to provide accurate payment details and authorise us to charge the total amount, including shipping costs.

5. SHIPPING AND DELIVERY

We ship via Australia Post (standard and express).

Estimated timeframes:

  • Dispatch: 1–3 business days
  • Delivery (Australia): 3–10 business days

Delivery times are estimates only and are not guaranteed.

For internationally sourced items:

  • delays may occur due to suppliers or customs
  • dispatch may take longer

We are not responsible for delays caused by shipping carriers or events outside our control.

6. RISK AND DELIVERY ISSUES

Risk in goods passes to you upon delivery.

However, if your order is lost or damaged in transit, please contact us. In accordance with Australian Consumer Law, we will work with you to provide an appropriate remedy, which may include replacement or refund.

7. INTELLECTUAL PROPERTY

All content on this website, including text, images, branding, graphics and design, is owned by Sur Books or its licensors and is protected by intellectual property laws.

You must not reproduce, distribute or use our content without prior written permission.

8. OPTIONAL TOOLS

We may provide access to third-party tools that we do not monitor or control.

These tools are provided “as is” and “as available”, without warranties or endorsement.

Your use of these tools is at your own risk.

9. THIRD-PARTY LINKS

Our Services may contain links to third-party websites.

We are not responsible for the content, accuracy or practices of third-party sites. Accessing them is at your own risk.

10. RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify.

All purchases are made directly with Sur Books. Shopify is not responsible for any aspect of transactions between you and us.

11. PRIVACY

Your personal information is handled in accordance with our Privacy Policy and Shopify’s Privacy Policy.

Information may be processed by third parties, including those located outside Australia.

12. FEEDBACK

If you submit feedback or content, you grant us a non-exclusive, royalty-free right to use it to improve and promote our Services.

You are responsible for ensuring that your submissions do not infringe any third-party rights.

13. ERRORS, INACCURACIES AND OMISSIONS

We may correct errors, inaccuracies or omissions at any time, including after an order has been placed.

You may not transfer or assign your rights under these Terms without our consent.

These Terms are governed by the laws of New South Wales, Australia.

24. CHANGES TO TERMS AND PRICING

We reserve the right to update or change these Terms, as well as product pricing, discounts and promotions, at any time without notice.

Changes apply only to future orders placed after the updated Terms are published.

Continued use of our Services constitutes acceptance of those changes.
